Dear Mr. Fitzsimmons:
Governor Cuomo asked me to respond to your letter expressing strong concerns about the delay in advancing High-Volume Hydraulic Fracturing (HVHF).
DEC recognizes the potential economic benefits HVHF could have for landowners and the communities where you and your members live. I appreciate the involvement the JLC has had in our process and the perspective your organization brings to the discussion about HVHF.
As I have said many times, this process is being driven by science and our goal is to develop regulations and permit conditions for natural gas development that will be fully protective of public health and the environment. I appreciate your support for our staff and the process that has been undertaken to date, as well as the recognition that the measures we are proposing will be the most stringent and protective in the nation — measures that will protect your members most directly should HVHF advance.
A decision will be made regarding whether to issue permits for gas drilling using HVHF once public comments on the 2011 draft Supplement Generic Environmental Impact Statement (SGEIS) have been responded to and any necessary revisions have been made to it, including possibly additional mitigation measures resulting from the New York State Department of Health review and recommendations.
As you know, we recently filed for an extension of time to complete our proposed regulations associated with HVHF, rather than letting them expire and restarting the rulemaking. As required, a 30-day public comment period commenced on December 12, 2012 and will run through January 11, 2013. DEC will then have until February 27, 2013 to either adopt the rules, or they will expire. These steps are necessary to provide appropriate opportunities for public input pursuant to the State Administrative Procedures Act.
