BH Commentary on: "FERC: Frackers Admit Frack Can Go Up to 2,000 Feet"

This is great, however
let's say we get the DEC to agree to a 2,000 foot setback
from water wells, principle aquifers, etc.

Will that make you happy?
It should NOT.

FIRST: We have TWO credible cases of water contamination
4,000' from drilling and/or fracking.


1) Franklin Forks, Susquehanna County PA,
2) Paradise Road, Terry Twp, Bradford County PA

Several homes affected in both cases.

NEXT: In Oct 2011, Carter Strickland, Commissioner of the NYC DEP
argues for a SEVEN MILE setback from NYC aqueducts due to the
risks of micro-seismic events:

LASTLY: I again want to point out the following things about water sources.

1) There is NO SCIENTIFIC BASIS for any of the following terms:
  • Primary Aquifer
  • Principle Aquifer
  • Sole Source Aquifer
  • Filtration Avoidance Determination / Unfiltered Water Supply
These are all POLITICAL terms (not scientific) which attempt to give greater
protections to water sources for places with higher population densities.

2) Only the term WATERSHED has a scientific and geological definition.

3) The NYC WATERSHED has been promised a 2,000 setback in the SGEIS
   (although this is NOT in the regs, which suggests that the permit conditions
    could be modified based on a site-specific review by DEC --> BAD IDEA)

4) A 2,000 foot setback from a watershed is the START of a good idea,
   however the incidents at  Franklin Forks PA and Terry Twp PA
indicate this should be AT LEAST 4,000 feet, and perhaps SEVEN MILES (37,000 ft).

5) Since EVERY SQUARE INCH of NY State is upstream of somebody's water supply,
  then If EVERY NY state watershed was given a ONE FOOT setback, then this would
  be a one foot setback from the state line, i.e. a BAN ON FRACKING IN NY.

WE were told the fractures extend for a "few hundred feet" by the folks at NYIOGA a few years back...

Which is 2X what Cuomo proposes as a separation of a horizontal from an aquifer
 
And 4X what Cuomo proposes as a setback from a water well 
 
And infinity from what Cuomo proposes as a setback from a property line.
 
Because Cuomo does not propose any setback of a horizontal lateral from a property line.. .
