Does the NY Public Service Commission regulate pipeline (x)?

Introduction:
I can remember this came up a couple of years ago at a meeting about the Leatherstocking pipeline,
and before that, when I heard Jim Austin give a talk in Chenango County at the 5-county
gas advisory board meeting, Jan 20, 2011.
Mr. Austin at that time mentioned that certain pipelines are completely unregulated
by NY State (under 125 psi OR less than 1,000').
The FIRST step is to figure out if the pipeline is regulated by FERC.
  1. GET THIS: The authority of authorship of the Regulations belongs with the legislature, which delegates authority to FERC. However, FERC delegates this to the industry itself (the industry being regulated) which defines the demarcation
    between a gathering line and a transmission line, was GIVEN BY FERC to INDUSTRY
    to decide! This rule, written by the American Petroleum Institute in API RP80,
    is incorporated by reference into the regs. BTW, it's also a TRADE SECRET
    and not easily viewable by the public.
  2. The NEXT step is to figure out of the pipeline is regulated by the NY PSC.
  3. Lastly, check to see if your NYS Regulated is Exempted.
