How many NYers are involved in the fight against fracking?

Engineers are good at making reasonable estimates based on incomplete information. I enjoy doing these kinds of numerical analyses. We call them "guesstimates". The goal is to get "close", which to a scientist usually means "within an order of magnitude of truth".
 
Estimating the number of NYers who are involved in the fight against fracking:


The two things we can look at where we have a good dataset are 1) local town bans, and 2) the number of public comments made on regulatory documents.

We can't really infer much from the 200,000+ comments made on the Proposed NY regs, because it is likely that people made more than one comment.

If we pick a somewhat large number of comments-per-person (to be conservative) and say each person made 10 comments each (I made about five on the regs, if I recall correctly), then this means there were 20,000 unique people who made a comment.

First guesstimate: 20,000 people have filed a comment on the SGEIS or the Regs.

Next is the local town bans. According to Fractracker, the current totals are currently 75 municipalities* with bans, and 102 moratoria. (* cities and towns)

So lets work with these numbers.

To get a ban or a moratorium in place, it requires active involvement of the citizens.

There are 4.3M registered voters in NY, so this means about 22% or 1:5 NYers vote.
This includes children, so that seem about right.

So lets assume that only 1/2 of the people who are registered to vote actually take part in elections, or would sign a petition. So we are saying only half of 22% or 11% of the population signed a petition.

This would be the minimum majority of registered voters (50% +1) needed to pass a YES/NO resolution.

So 11% of the 2,000,000 people who live in towns with a protective ordinance would be about 221,000 people. Let's call it 200,000.

There is our second estimate: 200,000 people have signed a petition for a protective ordinance.

NOTE: the numbers are likely much higher, due to the many towns in the Southern Tier who had active citizen efforts for a town ban, but which were refused for a vote by the town board. There are dozens of such towns.

So what defines "citizen engagement"?
Some ideas:
  • Attending a rally
  • Signing a petition for a ban
  • Filing comments on a regulatory proceeding
 So according to a very rough "guesstimate" we have a rough range of citizen involvement:

  20,000 people have filed a comment or attended a hearing
200,000 people have signed a petition for a ban

This seems about right, that about 1:10 petition signers are motivated enough to make a comment, so these numbers, calculated two different ways, both seem reasonable and pass initial "sanity checks".

How many people are actually opposed to Fracking in NY? Even if we take the Siena poll numbers, which are highly suspect, as we have pointed out (e.g., they do not show any indication in growth over 4 years, when other indicators show exponential growth), NYers are 44% against fracking. with 19.5M people living in NY, this would make 8.4 million NYers who oppose fracking.

Ho-hum... the return of the BOGUS Sienna Poll

That Sienna Poll essentially hasn't budged from 44% to 44% in 3 years.
Any poll of New York which does not indicate a SUPER-MAJORITY defies logic and perceptions.
All scientific statements should match observable reality.

The head pollster at Siena is a guy named Steve Greenberg.
Check out his background -> it's PUBLIC RELATIONS! WTF?

The purpose of polling is to LEARN public opinion.
The purpose of Public Relations is to CREATE public opinion.
(Goals are Opposite / Classic Fox Guarding Henhouse)

That Sienna Poll is clearly an Uncalibrated Instrument,
like a radar gun that clocks a turtle going 42 MPH => DOES NOT MATCH OBSERVED REALITY -- NEEDS CALIBRATION.

 
Here is the FACT-BASED evidence that Siena poll is BULLSHIT:

The Power of Words

Today's Siena poll is a mixed bag for Gov. Andrew Cuomo, bringing him good news about the constitutional amendment on casino gambling (not to mention his manipulation of the ballot amendment wording on the subject), but bad news about his own job approval and favorability ratings. 
 
For the first time ever, Cuomo's job performance rating has slipped just below the magic 50 percent number - a development that comes as he prepares to seek re-election next fall. 
 
Cuomo saw a slight drop in his favorability rating, a small drop in his "re-elect" number, and a small drop in his job performance rating, bringing him to his lowest level - 49-50, down from 52-46 percent in August - since he took office in January 2011.
 
The governor is viewed favorably by 64 percent of voters and unfavorably by 32 percent (down slightly from 65-30 percent in August). 
 
He has a 49-50 percent job performance rating (down from 52-46 in August). 
 
Fifty-two percent say they are prepared to re-elect him, while 39 percent would prefer someone else (down from 55-35 percent last month). 
 
Cuomo is still doing well (60 percent) among Democrats and New York City voters are prepared to re-elect him, but a plurality of Republicans and independents and a majority of upstaters say they'd prefer someone else in the executive mansion. 
 
When it comings to casino gambling, New Yorkers remain evenly divided at 46-46, down from 49-42 last month, on whether to allow the expansion of non-Indian run gaming facilities across the state. 
 
But, when given the specific wording of the amendment on the ballot in November, which plays up the job growth and property tax reduction possibilities of more gambling, voters changed their tune. 
 
Fifty-five percent said they would vote "yes" on that amendment, compared to 42 percent who said they would not.
 
"Clearly, the wording on the ballot for the casino amendment matters," Siena pollster Steve Greenberg concluded.
 
Also, a small majority of voters said they think the amendment is fairly worded, although that depends in part on whether the voters were pro or anti-casino expansion in the first place. 

So far, Cuomo has declined to get involved in the casino amendment push, although some believe he's waiting until the most opportune moment - like, say, the final days of the election season when the most voters are paying attention - to make his mark. 

But from this poll, it appears Cuomo has already done quite enough with his administration's manipulation of the amendment wording - not to mention its placement, which will be No. 1 of the six constitutional questions appearing on the November ballot. 

Meanwhile the pro-casino movement (mostly developers) are largely keeping their powder dry, though they're reportedly willing to spend some $20 million on an ad campaign, and underfunded opponents are relying on grassroots organizing to spread their message. 

The antis did get a boost this weekend when the state's Roman Catholic bishops warned of social problems linked with gambling, although they stopped short of telling New Yorkers how to vote on the amendment on Nov. 5. 
 
Today's poll also reveals that for the first time in nearly two years, more New Yorkers (46-43) believe the state is heading in the wrong direction than those who believe we're on the right course - not a good trend for the governor as he preps for 2014. 
 
On the controversial question of fracking, the largest plurality ever in a Siena poll has said "no" to the natural gas drilling technique, with 45 percent opposed and 37 percent in favor. 
 
Heading into the 2014-15 budget season, voters say by a 53-41 percent margin they would rather see an increase in state spending in areas such as education than a broad-based tax cut. 
 
However, three-quarters of voters believe a state income tax cut in next year's budget is at least somewhat important.
 
And last but not least, some not-so-fabulous news for former Gov. Eliot Spitzer if he was perhaps mulling another comeback attempt - maybe a run at state Comptroller Tom DiNapoli? - after he failed NYC comptroller bid this fall. 
 
At least 62 percent of voters from every region of the state and every party agree that Spitzer should leave his political aspirations on the shelf next year and refrain from seeking statewide office, although he does continue to have a reservoir of support (more than 40 percent) among black and Latino voters.

From 9 a.m. to 3 p.m., Senate's Standing Committee on Energy and Telecommunications holds a public hearing to discuss the PSC's review of Indian Point, 250 Broadway, 19th floor, Manhattan.
Activists from the group Shut Down Indian Point Now! hold a demonstration outside 250 Broadway while that hearing is taking place.
At 9:45 a.m., AG Eric Schneiderman will announce a new settlement to resolve abuses against New York borrowers during his keynote address at the PEF Conference, Buffalo Niagara Convention Center

At 10:30 a.m., Independence Party mayoral candidate Adolfo Carrion will announce the launch of his Campaign for New York's High-Tech Future and the new integrated mobile application MyCity Pass, City Hall Park, Manhattan.
At 11 a.m., NYC Democratic mayoral candidate Bill de Blasio tours the early childhood education program at Children's Aid Society and discusses his plan for universal pre-k, 130 East 101st St., Manhattan.
Also at 11 a.m., EPA Regional Administrator Judith Enck, Rep. Nydia Velazquez and other officials discuss efforts to remove pollution from the Gowanus Canal, a federal Superfund site; northeast corner of the Lowe's parking lot, 118 Second Ave., Brooklyn.

I speak for no organization, no group, only myself. But I will tell you --> this is a BIG BIG BIG mistake.

Before you FRACK US-- don't you want to get to know us first? Come over here and try to find that "dying economy". Where do you get that from? Sounds like IPAA / IOGA / API PR/Hype/BULL-SH*T

Don't listen to that BS Siena Poll. It's an uncalibrated instrument giving a clearly false result. The people ARE NOT split on the issue. Try to find a majority here who wants fracking. (What you will find is the opposite). Prove to us that fracking can be done safely. IT CANNOT. And those "frack us first" resolutions WERE NOT passed by referendum, but under the cloak of darkness WITHOUT public input.

We've looked at the science too, and have seen that FRACKING IS INHERENTLY UNSAFE. It's harms CANNOT be regulated or mitigated. Fracking is MURDER. It is war. If Governor Andrew Cuomo issues ONE PERMIT, we will consider it an act of aggression. And we will take measures to protect ourselves against aggressors.

Does the Governor want a Civil War? Do you want blood on your hands?
CEASE AND DESIST! We will protect this land.

Susan Arbetter: YOUR JOB as a journalist is to ASK TOUGH QUESTIONS

First suspicion:
What is Greenberg's qualifications? Statistical methods?
NOPE! Greenberg is a PSYCHOLOGIST with a background in
PUBLIC RELATIONS! He's a SPIN DOCTOR.

Why does Siena college employ a PR Propagandist in order to shop their Poll Results??
Now, the data:

Siena Polling claims to have shown a consistant 45%-45% split
(or thereabouts) on fracking in NY for TWO YEARS. (No majority either way)

However THIS DOES NOT MATCH OBSERVABLE FACTS.
I have measured a SUPER-MAJORITY against fracking in NY
a half-dozen different ways. Let's just look at THREE.

Senator Libous Poll shows 57% of his constituents  think the DEC is not doing enough to protect NYers.

Number of comments on DEC documents, indicates exponential growth.

Gov. Cuomo has not issued a BAN ON FRACKING
because Greenberg/Siena has his ear,
and have convinced him of a FALSEHOOD,
that is, that the people are split on fracking.
WE ARE NOT SPLIT!
There is a SUPER-MAJORITY of NYers who are against it!
This is the biggest environmental movement in 50 years!

If the Siena Poll does not reflect it,
then THERE IS SOMETHING WRONG with their methods. 

We in the Southern Tier ARE NOT STUPID.
This Poll is PROPAGANDA.
PLEASE REPORT THIS ANOMOLY ON YOUR SHOW.




1: SUPER-MAJORITIES SUPPORT LOCAL BANS
THROUGHOUT AFFECTED AREAS


In May, I did a statewide survey of local groups who are taking ban petitions door to door.
About 30 groups responded, and I was consistently hearing that

OF THE PEOPLE ASKED, consistent super-majorities (2/3) would sign for a ban.
In some places, it's as high as 90% (9/10)
with 80% (4/5) being around the average reported.

2: COMMENTS AT DEC HEARINGS WERE 81% AGAINST FRACKING

This was also reflected in the comments at the DEC hearings.
I attended and recorded all 11 sessions.
(Oneonta, 2x Dansville, 2x Binghamton, 2x Loch Sheldrake, 2x NYC, Ithaca, Delhi)

Again, of the people who bothered to show up and give a comment,
OVERALL these comments were (drum roll) 81% against fracking.

3: GANNETT REPORTS DEC COMMENTS WERE 10 -TO- 1 AGAINST FRACKING

4: LOCAL BANS UP NEARLY 400%,
MORATORIA UP 900% IN ONE YEAR
According to Fractracker, the number of local bans have quadrupled in one year
(from 8 to 31), and the number moratoria are up a whopping 9x! (from 10 to 90).
And since each ban is based on many local petition signatures, this is hard evidence
of the size of this massive AND GROWING environmental movement sweeping through NY.

5: DO THE MATH
In reality, only about 3-5% of the people will get very rich from this, maybe another 10%
in service industries will get moderate benefit. Call it 15%

FOR EVERYONE ELSE, there is only a threat, to water, to air, to food, to quality of life,
a THREAT TO LIFE ITSELF!

So here's a little thought-experiment:

Why you be FOR something that threatens your LIFE and gives you no benefit???
Of course the people are against fracking!This threat is beyond an intellectual "understanding".

Our bodies are 80% water. This threat to water is FELT IN THE BODY.

A Timeline of Fracking Regulations in NY

Wow! I was doing some research on the early days of the SGEIS, and stumbled upon this very complete history of fracking in NY, by Chip Northrup



Not sure who did the original research, but a lot of this information is also here:
WSKG just also put up a timeline:



There is unique information in all these. I have tried to consolidate them, and also added a couple of key dates important to my research of the evolution of the SGEIS, and made a couple of small corrections.


1972 -- First NY O+G regulations

Basically, this allowed for DEC to use with a one-size-fits-few generic approach to every oil and gas permit in NY.

1997 - Revised Oil + Gas regulations drafted, but kept secret

1997 --  After the finalization of the 1992 GEIS, the DEC was obligated to revise its oil and gas drilling regulations – in line with the updated GEIS. Over a period of 5 years, DEC held meetings, took input, and drafted revised regulations in 1997.

The DEC did not share those revised regulations with the public or legislators when it issued a supplemental GEIS, the SGEIS. And in fact declared that it had “lost” the 1997 drafts – because the 1997 drafts offered substantially more protections for the general public, adjacent landowners and the environment than the regulations the  DEC issued on November 29, 2012

Norma Fiorentina's water well in Dimock, PA explodes after methane accumulated in the well.

Later that year, 15 Dimock families file a lawsuit against nearby driller Cabot Oil and Gas for contamination of water wells. Cabot denies that their wells are the source of the methane, but provide water to the affected homes until late 2011, before the Environmental Protection Agency took over at some homes.

The Environmental Protection Agency launches a national study into the hazards of hydrofracking, following up on a 2004 study that found the drilling technique did not pose a threat to drinking water. The new study is expected to be completed in 2014.
October 21, 2010 -- DEC Commissioner Pete Grannis fired by Governor Patterson’s Chief of Staff Larry Schwartz. He was fired after a memo from Grannis was leaked to the press earlier in the week where Grannis complained to the Budget Division about the 209 layoffs of DEC employees cutting the agency’s staff by 22% since April 2008.

Jan 11, 2012 -- The January 12th meeting of the state's High-Volume Hydraulic Fracturing Advisory Panel was abruptly canceled and postponed to January 26. Then the January 26th meeting was canceled and the panel never reconvened. In June, reporter Jon Campbell broke the story that the the NYS Conference of Environmental Health Directors and the NYS Association of County Health Officials (NYSACHO) were scheduled to present two separate reports at the January 12th meeting on concerns about how fracking could burden County Health agencies. Their reports were never distributed to the DEC's advisory board, nor were they formally released to the public. Furthermore, the DEC had said the Jan. 12 meeting was postponed because the "main presenter requested additional time to prepare." Yet Linda Wagner, executive director of the Association of County Health Officials, said in an e-mail to Campbell that the group asked to postpone "due to weather concerns for those traveling."

DEC Requests Additional Time; Public Comment will be Reopened. New York State Department of Health Commissioner Nirav Shah requests more time to complete the health review. Final regulations will be reopened for public comment; decision on hydrofracking in New York delayed again.

March 6, 2013 NY Assembly Passes 2-Year Moratorium

By a 95-40 vote, the Democratic-controlled assembly passed a moratorium that would ban fracking in New York until May, 2015. A similar bill is waiting in the Republican-controlled Senate, where it is considered much less likely to pass.
